Timofey Bokarev Internet marketing agency (http://wwwpromo.ru), a Russian company specializing in network advertising, accused the Poznavatelnaya Kniga Plus publishing house of plagiarism. The latter company has published a book "Advertising in Internet" by Anton Vysotkin. Timofey Bokarev claims 54% of it to be the materials presented at his website. Timofey Bokarev, Infoart notes, has been thinking of publishing a book on Internet advertising for a long time and has already prepared materials for it. Now the author has brought an action against Poznavatelnaya Kniga and is determined to carry the case through. "This is not the first plagiarism which I know", he says, "yet this is a specific case and I have plenty of proofs in my favour; what is the most important, I definitely wish to carry the case through." Timofey Bokarev says he has indisputable proofs showing that the materials stolen from his site belong to him. First of all, these are publications which first appeared in printed media and only then were transferred to http://wwwpromo.ru. On top of that, for the first time in Russian jurisprudence, data presented by IT systems will be considered as evidences. These data include search engines' printouts stating the date when the content of the website was indexed, as well as certificates from the major Russian search engines, Rambler, Yandex, and Aport, indicating the date when the information was first published at the website and confirming that it has not changed since that. Finally, Timofey Bokarev will present a certificate from Zenon N.S.P. company, which hosts his website, indicating the date when the information was publised at the site. Timofey Bokarev believes that he has all chances to win the case. Should it happen, it will be a real sensation for Russia, where Internet is continuously suffering from lack of legislation base. The Poznavatelnaya Kniga Plus is reported to has already applied to him asking to settle the case peacefully, yet Timofey Bokarev has made a decision to take the case to court. "A couple of years ago all problems in Internet could be settled at the level of personal conflicts," he says. "Yet today Internet is money, is a new audience, thus relationships in the Net are built at the quite different level. Never should you think that in Russian Internet everyone is allowed to do whatever he wishes; it is not the case. Internet is not an abstract thing but an aspect of our actual life. I believe that now it is time for everyone to protect his resources. The lawsuit against Poznavatelnaya Kniga Plus will be an excellent precedent in Runet (Russian Internet), which is needed for all of us. It will use Internet evidences along with other sorts of evidences." Source: InfoArt News Agency
